BeeDesigner Terms and Conditions
Last Updated: April 1, 2024
These Terms and Conditions (“Terms”) govern access to and use of beedesigner.org (the “Website”) and all digital products and services offered by BeeDesigner, located at 1929 E Richards Dr, Tempe, Arizona 85282, United States (“BeeDesigner,” “we,” “us,” or “our”).
By accessing the Website, creating an account, submitting an order, accepting a quotation or invoice, clicking an acceptance checkbox, or completing payment, you agree to be bound by these Terms.
Please do not use the Website or purchase from BeeDesigner unless you agree to these Terms.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to purchase from BeeDesigner.
A person under 18 may use the Website or purchase a product only with the permission and supervision of a parent or legal guardian. The parent or guardian is responsible for the minor’s activity and purchases.
By using the Website, you represent that the information you provide is accurate and that you are legally permitted to enter into these Terms.
2. Products and Services
BeeDesigner provides digital products and creative services, including:
- CV and résumé templates
- Document templates
- Digital designs
- Downloadable design materials
- Tutorials and educational content
- Custom design services
- Related digital products and services
The specific contents, features, formats, compatibility requirements, delivery time, licence, revisions, and scope of each order will be stated on the applicable product page, quotation, invoice, payment link, or written order confirmation.
We may add, remove, update, or discontinue products and services at any time. Changes will not remove rights relating to an order already accepted and paid for.
3. Customer-Service Discussion and Order Confirmation
Customers are expected to communicate with or confirm their order through BeeDesigner customer service before completing payment.
By completing payment, you confirm that:
- You discussed or confirmed your requirements with BeeDesigner.
- You received sufficient information about the product or service.
- You had the opportunity to ask questions and request clarification.
- You reviewed the relevant product description, service package, quotation, invoice, payment request, or scope of work.
- You understood the price, features, format, limitations, delivery method, and expected delivery time.
- You approved the order details.
- You voluntarily decided to complete the purchase.
- You authorized BeeDesigner to deliver the digital product or begin performing the service immediately.
Payment constitutes acceptance of the order details presented or discussed before payment.
A customer-service discussion does not remove any right that cannot legally be excluded.
4. Orders and Contract Formation
Submitting payment does not require BeeDesigner to accept an order in every circumstance.
An order is accepted when BeeDesigner:
- Provides access to the purchased digital product;
- Sends the purchased digital product;
- Confirms the order in writing; or
- Begins performing the purchased custom service.
We may reject or cancel an order before delivery or commencement of work where:
- The product or service is unavailable.
- The price or product information contains an obvious error.
- Payment was unsuccessful, reversed, or identified as potentially fraudulent.
- The requested work is unlawful, abusive, discriminatory, misleading, or infringes another person’s rights.
- The customer has violated these Terms.
- BeeDesigner reasonably determines that it cannot complete the requested work.
Where BeeDesigner cancels an accepted order without having delivered the product or begun work, the customer will receive an appropriate refund.
5. Prices, Payments, and Taxes
Prices are displayed in the currency shown at checkout, on the invoice, or in the applicable quotation. Unless otherwise stated, prices are displayed in United States dollars.
BeeDesigner accepts payment through authorized methods including:
- PayPal
- Credit cards
- Debit cards
You authorize BeeDesigner and its payment providers to charge the total amount displayed or agreed before payment.
You are responsible for:
- Providing accurate billing information.
- Ensuring that you are authorized to use the selected payment method.
- Any currency-conversion charges imposed by your payment provider.
- Any taxes, duties, or similar government charges that are not collected by BeeDesigner.
BeeDesigner may collect applicable sales, use, value-added, or similar taxes where required.
Prices may change at any time. A price change will not affect an order already accepted and paid for.
6. Digital Delivery
Digital products are generally delivered instantly after successful payment. In some circumstances, delivery may take up to 24 hours.
Delivery may occur through:
- A direct website download
- A download link
- A customer account
- A shared online folder
- Another electronic delivery method
You are responsible for providing a correct and accessible email address and for checking spam, junk, and filtered folders.
You must contact [email protected] if the purchased product has not arrived within 24 hours after successful payment.
A product is considered delivered when it is made available through the agreed delivery method, subject to any mandatory legal requirements.
7. Immediate Performance
By completing payment, you request and authorize BeeDesigner to:
- Deliver digital content immediately; and
- Begin custom design work immediately.
For custom services, work may be considered started when BeeDesigner reviews the order, examines customer materials, conducts research, reserves production time, assigns a designer, prepares concepts, creates drafts, or performs any other order-specific activity.
Customers in jurisdictions that provide a cancellation or withdrawal period may be asked to give separate express consent to immediate delivery or performance and to acknowledge the effect this may have on their cancellation rights.
8. Digital Product Licence
Unless a product page, invoice, or written licence expressly provides different rights, BeeDesigner grants the purchaser a limited, non-exclusive, non-transferable, non-sublicensable licence to use the purchased digital product for the purchaser’s own personal or internal business purposes.
Permitted uses
Subject to the applicable product description, you may:
- Download and store a reasonable number of backup copies.
- Edit a template for your own use.
- Use a CV or résumé template to create your own professional documents.
- Use an eligible design in your own personal or business materials.
- View tutorials for your own educational use.
- Print completed end-use documents for your own purposes.
A licence is granted to the purchaser only. Purchasing a product does not transfer ownership of BeeDesigner’s original template, source material, tutorial, or underlying intellectual property.
Prohibited uses
Unless BeeDesigner gives prior written permission, you must not:
- Resell, redistribute, sublicense, rent, lend, or give away a purchased product.
- Share a download link, account, source file, or editable template with another person.
- Upload a BeeDesigner product to a file-sharing site, template marketplace, membership platform, or public database.
- Sell or distribute an editable or substantially unchanged version of a BeeDesigner product.
- Use a BeeDesigner product to create a competing template, tutorial, design library, or downloadable product.
- Claim that BeeDesigner’s original product was created entirely by you.
- Remove copyright, licence, trademark, or ownership notices.
- Reverse engineer, extract, scrape, or reproduce protected Website content.
- Use a single-user licence for multiple customers, employees, businesses, or organizations.
- Use a product for unlawful, fraudulent, defamatory, discriminatory, or misleading purposes.
A separate commercial, extended, multi-user, or agency licence may be required for broader use.
9. Intellectual Property
The Website and its contents—including templates, tutorials, graphics, layouts, branding, text, illustrations, icons, product previews, code, and downloadable materials—are owned by or licensed to BeeDesigner and are protected by applicable intellectual-property laws.
“BeeDesigner,” BeeDesigner branding, logos, and related identifiers may not be used without written permission.
Except for the limited rights expressly granted under these Terms, no ownership or intellectual-property rights are transferred to you.
10. Custom Design Ownership
The ownership and usage rights for custom design work will be determined by the applicable quotation, invoice, service description, or written agreement.
Unless BeeDesigner expressly agrees otherwise in writing, full payment grants the customer a licence to use the final approved custom design for the purpose stated in the order.
BeeDesigner retains ownership of:
- Pre-existing templates and design systems
- Reusable design elements
- Internal methods, tools, and processes
- Working files and production files
- Unselected or rejected concepts
- Drafts not included in the final deliverables
- Fonts, stock assets, and third-party materials
- General knowledge, skills, and techniques used during the project
Editable or source files are included only where the order description or invoice expressly states that they are included.
An exclusive licence, copyright assignment, trademark transfer, or transfer of editable source files must be expressly agreed in writing and may be subject to an additional fee.
11. Third-Party Assets
Products or custom designs may include third-party fonts, photographs, icons, mockups, software, or other licensed assets.
Third-party materials remain subject to their respective licence terms. BeeDesigner cannot grant rights greater than those provided by the relevant third-party owner.
Where a separate licence, subscription, font purchase, or software installation is required, the customer is responsible for obtaining and maintaining it unless the order expressly states otherwise.
BeeDesigner is not responsible for changes made by a third-party asset provider after delivery.
12. Customer Materials
You may provide text, photographs, logos, trademarks, documents, instructions, or other materials for a custom order.
You retain ownership of materials you lawfully own. You grant BeeDesigner a limited licence to access, copy, edit, format, reproduce, and otherwise use those materials only as reasonably necessary to fulfil the order, provide support, maintain business records, and handle disputes.
You represent that:
- You own the submitted materials or have permission to use them.
- BeeDesigner’s use of the materials as instructed will not infringe another person’s rights.
- The materials are accurate and lawful.
- The materials do not contain malware, unlawful content, or confidential information you are not authorized to share.
You are responsible for claims arising from materials or instructions you supplied, except to the extent caused by BeeDesigner’s independent conduct.
13. Custom Design Process
Customers must provide complete, accurate, and timely instructions.
Delivery schedules may be extended when:
- The customer delays providing required information.
- The customer changes the project scope.
- The customer submits conflicting instructions.
- Additional work is requested.
- BeeDesigner is waiting for customer feedback or approval.
- Circumstances outside BeeDesigner’s reasonable control cause a delay.
BeeDesigner is not responsible for delays caused by incomplete instructions, delayed responses, third-party services, or customer-requested changes.
14. Revisions
Unless the applicable order states otherwise, custom design services include up to three revision rounds.
A revision round consists of one consolidated set of changes submitted by the customer.
Revision requests must:
- Be submitted within 72 hours after delivery of the relevant draft.
- Be clear and complete.
- Remain within the original scope.
- Be consistent with the originally approved direction.
The following may require an additional fee:
- A new concept or complete redesign
- A change in the original project direction
- Additional pages, formats, dimensions, or deliverables
- Corrections resulting from inaccurate customer information
- Requests outside the agreed scope
- Requests after the three revision rounds are used
- Requests submitted after the 72-hour revision period
Unused revisions have no cash value and cannot be exchanged for a refund.
A project may be administratively closed after the revision period expires. Closing a project does not remove statutory rights concerning defective or non-conforming work.
15. Customer Approval
You are responsible for carefully reviewing drafts and final deliverables before approval or use.
This includes checking:
- Names and contact information
- Spelling and grammar
- Dates and numerical information
- Links and contact details
- Colours and dimensions
- Product specifications
- Legal, medical, financial, or professional statements
- Trademark and copyright permissions
BeeDesigner is not responsible for an error that the customer approved, except where liability cannot legally be excluded.
Changes requested after final approval may be treated as additional paid work.
16. Refunds and Cancellations
Purchases are governed by BeeDesigner’s separately published Refund and Cancellation Policy, which is incorporated into these Terms.
In general:
- Digital products are not eligible for change-of-mind refunds after access or download begins.
- Custom services are not eligible for change-of-mind refunds after work begins.
- Eligible problems must normally be reported within 30 calendar days.
- Refunds or other remedies may remain available for duplicate payments, non-delivery, corrupted files, materially misdescribed products, unperformed services, unauthorized transactions, or where required by law.
The 30-day request period does not mean that every purchase can be cancelled for any reason for 30 days.
Nothing in these Terms limits a mandatory consumer right.
17. Payment Disputes and Chargebacks
Customers are encouraged to contact BeeDesigner at [email protected] before opening a PayPal dispute or card chargeback so that BeeDesigner has an opportunity to investigate.
Nothing in this section prevents a customer from exercising a valid right through PayPal, a card issuer, a bank, or applicable law.
BeeDesigner may respond to a dispute by providing:
- Order and payment records
- Customer-service communications
- Customer instructions
- Checkout acknowledgments
- Product descriptions
- Delivery emails
- Download or access logs
- IP or account-access information
- Drafts and completed files
- Revision requests
- Customer approvals
- Evidence that work began or was delivered
A customer must not knowingly obtain duplicate reimbursement for the same transaction through both BeeDesigner and a payment provider.
18. Tutorials and Educational Information
Tutorials and educational materials are provided for general informational purposes.
They do not constitute legal, financial, tax, employment, medical, or other regulated professional advice.
Results depend on the customer’s circumstances, skills, implementation, market conditions, and decisions made by third parties.
19. No Guarantee of Results
BeeDesigner does not guarantee:
- Employment or job interviews
- Employer or recruiter approval
- A particular applicant-tracking-system score
- Increased income, sales, traffic, or conversions
- Business success
- Social-media performance
- Acceptance by a platform, institution, or third party
- Trademark registration
- Any specific personal, professional, or commercial outcome
A failure to achieve a hoped-for result does not by itself mean that a product or service is defective.
20. Portfolio Use
Unless confidentiality is agreed in writing before work begins, BeeDesigner may display non-confidential portions of completed custom work in its portfolio, Website, proposals, or social-media channels after the work has been publicly released by the customer.
BeeDesigner will not intentionally publish private personal information, unpublished CV details, confidential business information, passwords, financial details, or other sensitive customer information.
A customer may request confidentiality before purchasing. Additional terms or fees may apply where confidentiality prevents normal portfolio use.
21. Accounts and Security
Where the Website offers customer accounts, you are responsible for:
- Maintaining the confidentiality of your password.
- Restricting access to your account.
- Providing accurate account information.
- Promptly reporting suspected unauthorized access.
You are responsible for activity performed through your account unless caused by BeeDesigner’s failure to use reasonable security measures.
We may suspend an account where we reasonably suspect fraud, security risks, unauthorized sharing, or a violation of these Terms.
22. Acceptable Use
You must not:
- Use the Website unlawfully or fraudulently.
- Interfere with the Website’s security or operation.
- Introduce malware or malicious code.
- Attempt unauthorized access to accounts, systems, or data.
- Scrape, crawl, harvest, or automatically extract Website content without permission.
- Circumvent access, payment, licence, or download restrictions.
- Impersonate another person or misrepresent your identity.
- Use the Website to violate intellectual-property, privacy, publicity, or other rights.
- Submit abusive, threatening, hateful, defamatory, or illegal content.
- Make fraudulent payment disputes or refund requests.
- Use purchased materials beyond the applicable licence.
We may restrict or terminate access for violations.
23. Reviews and Feedback
Customers may provide honest reviews, comments, or feedback about BeeDesigner.
You must not submit a review that:
- Contains knowingly false factual statements.
- Impersonates another person.
- Discloses private information unlawfully.
- Contains threats, harassment, malware, or illegal content.
- Was submitted in exchange for undisclosed compensation.
Nothing in these Terms prevents a customer from expressing an honest opinion or making a genuine complaint.
Feedback and general suggestions submitted to BeeDesigner may be used to improve products and services without payment, provided that BeeDesigner does not claim ownership of the customer’s confidential materials.
24. Website Availability
We aim to keep the Website reasonably available but do not guarantee uninterrupted or error-free access.
The Website may be temporarily unavailable because of:
- Maintenance
- Security updates
- Hosting or network failures
- Payment-provider interruptions
- Technical problems
- Events outside our reasonable control
We may change the Website’s design, functionality, and content without notice, provided that this does not improperly remove access to a paid product.
25. Errors and Corrections
We attempt to present accurate product descriptions, previews, prices, and availability information.
We may correct typographical, technical, pricing, or display errors.
Where an obvious error affects an unfulfilled order, we may give the customer the option to proceed under the corrected terms or receive a refund.
Minor differences caused by screen settings, software, printers, devices, fonts, or browsers do not necessarily mean that a product is defective.
26. Third-Party Services and Links
The Website may link to or rely on third-party services, including payment processors, hosting providers, software platforms, font providers, and social-media services.
BeeDesigner does not control third-party services and is not responsible for their independent content, policies, availability, or conduct.
Your use of a third-party service may be governed by that provider’s own terms and privacy policy.
27. Privacy
BeeDesigner’s collection and use of personal information are governed by its Privacy Policy and applicable law.
By submitting an order, you authorize BeeDesigner to process information reasonably necessary to:
- Process payment
- Deliver products
- Perform services
- Communicate about the order
- Provide customer support
- Prevent fraud
- Maintain accounting and transaction records
- Respond to disputes
- Comply with legal obligations
Payment-card information may be processed directly by third-party payment providers rather than stored by BeeDesigner.
28. Electronic Communications
You consent to receive order confirmations, invoices, delivery messages, policy notices, and other transaction-related communications electronically.
Electronic records, acceptance checkboxes, payment confirmations, and email communications may be used to demonstrate the agreement between you and BeeDesigner.
You are responsible for keeping your contact information current.
29. Disclaimer of Warranties
To the extent permitted by law, the Website and its content are provided on an “as available” basis.
BeeDesigner does not warrant that:
- The Website will always be uninterrupted or error-free.
- Every product will be compatible with every device or software version.
- Tutorials will produce a particular result.
- Third-party platforms or services will remain available.
- Every design will satisfy the subjective preferences of every third party.
This section does not exclude an express product description, agreed service obligation, or warranty or consumer right that cannot legally be excluded.
30. Limitation of Liability
To the maximum extent permitted by law, BeeDesigner will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses, including lost profits, lost opportunities, loss of goodwill, loss of data, or business interruption.
Where liability can lawfully be limited, BeeDesigner’s total liability arising from a particular product, service, or order will not exceed the amount the customer paid BeeDesigner for that product, service, or order.
These limitations do not apply where liability cannot legally be limited, including liability arising from fraud, intentional misconduct, or other matters protected by mandatory law.
31. Indemnification
To the extent permitted by law, you agree to reimburse BeeDesigner for reasonable losses, liabilities, and costs resulting from:
- Your material violation of these Terms.
- Your unlawful use of the Website or a purchased product.
- Materials or instructions you supplied that infringe another person’s rights.
- Your unauthorized resale, redistribution, or sharing of BeeDesigner content.
- Fraudulent activity performed through your account.
This section does not require you to indemnify BeeDesigner for losses caused by BeeDesigner’s own unlawful conduct, negligence, or breach.
32. Intellectual-Property Complaints
A person who believes that content on the Website infringes their intellectual-property rights may contact:
Email: [email protected]
The complaint should include:
- Identification of the protected work.
- Identification and location of the allegedly infringing material.
- The complainant’s name and contact information.
- An explanation of the complainant’s rights.
- A good-faith statement that the disputed use is not authorized.
- A statement that the information provided is accurate.
- A physical or electronic signature.
BeeDesigner may request additional information and may remove or restrict disputed material while investigating.
This section does not represent that BeeDesigner has registered a designated DMCA agent unless such registration has actually been completed with the United States Copyright Office.
33. Suspension and Termination
BeeDesigner may suspend or terminate access to the Website, an account, or a product licence where a customer:
- Materially violates these Terms.
- Engages in fraud or unlawful activity.
- Shares or resells licensed content without authorization.
- Creates a security risk.
- Abuses BeeDesigner staff or systems.
- Fails to pay an amount properly due.
Where reasonably possible, BeeDesigner may provide notice and an opportunity to correct the violation.
Termination does not remove payment obligations or provisions that are intended to survive, including intellectual-property, licence restrictions, liability, indemnification, and dispute provisions.
34. Force Majeure
BeeDesigner will not be responsible for a delay or failure caused by circumstances beyond its reasonable control, including natural disasters, war, civil unrest, government action, internet failures, hosting outages, widespread software failures, power outages, labour disruptions, epidemics, or payment-network interruptions.
BeeDesigner will make reasonable efforts to resume affected services.
35. Governing Law and Disputes
Before beginning formal legal proceedings, the parties should make a reasonable effort to resolve the matter by contacting [email protected] and providing sufficient details about the dispute.
Except where mandatory consumer law provides otherwise, these Terms are governed by the laws of the State of Arizona and applicable United States federal law, without regard to conflict-of-law principles.
Except where a consumer is legally entitled to bring a claim elsewhere, disputes relating to these Terms will be brought in a court with appropriate jurisdiction in Maricopa County, Arizona.
Nothing in this section removes a consumer’s right to use an applicable small-claims procedure, payment-provider process, regulatory complaint process, or mandatory legal remedy.
36. International Customers
BeeDesigner operates from Arizona, United States, and sells to customers in multiple countries, including the United States, Canada, the United Kingdom, and European Union member states.
Customers are responsible for complying with laws applicable to their use of purchased materials.
Nothing in these Terms excludes consumer rights that cannot legally be excluded in the customer’s country or region.
Where these Terms conflict with mandatory applicable law, the mandatory law will apply to the extent of the conflict.
37. Changes to These Terms
BeeDesigner may update these Terms to reflect changes in its products, Website, business practices, payment methods, or legal obligations.
Updated Terms will be posted with a revised “Last Updated” date.
Changes will generally apply prospectively. A completed purchase will normally remain governed by the version accepted when the purchase was made unless:
- The customer expressly agrees to updated terms;
- A change is required by law; or
- The change does not materially reduce the customer’s existing rights.
Continued use of the Website after updated Terms become effective constitutes acceptance regarding future Website use.
38. Order of Precedence
Where documents conflict, the following order will generally apply:
- A specifically negotiated written agreement signed or electronically accepted by BeeDesigner and the customer.
- The applicable quotation, invoice, or written order confirmation.
- The applicable product or service description.
- The Refund and Cancellation Policy for refund-related matters.
- These Terms.
Mandatory applicable law always takes priority.
39. General Provisions
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
A failure by BeeDesigner to enforce a provision immediately does not waive the right to enforce it later.
You may not transfer your rights or obligations under these Terms without BeeDesigner’s written permission. BeeDesigner may transfer these Terms as part of a merger, reorganization, financing, or sale of its business or assets, subject to applicable law.
These Terms, together with the applicable order documents, Refund and Cancellation Policy, Privacy Policy, and any specific licence, constitute the entire agreement relating to the applicable transaction.
Headings are provided for convenience and do not change the meaning of these Terms.
